EVERWILLOW LLC
Terms of Use
Last updated: October 7, 2026
Welcome to www.everwillowcare.com (the “Site”), operated by Everwillow LLC (“Everwillow,” “we,” “us,” “our”). These Terms of Use (the “Terms”) govern your use of the Site, our newsletter, our booking and contact tools, and your purchase of coaching services. By using the Site or buying our services, you agree to these Terms. If you do not agree, please do not use the Site. Questions can be directed to hello@everwillowcare.com.
1. How these documents fit together. These Terms work with our Disclaimer, Privacy Policy, Cookie Notice, and Consumer Health Data Privacy Notice, and, for clients, your Coaching Services Agreement, Payment Authorization & Payment Plan Terms, and Cancellation, Rescheduling, Pause & Refund Policy. If these Terms conflict with your Coaching Services Agreement about the services, the Agreement controls.
2. Who can use the Site. You must be at least 18 years old and able to enter a binding contract. By using the Site, you confirm that you are. Our services are not intended for anyone under 18.
3. Our services. Everwillow offers one-on-one virtual coaching in fixed Packages: The Pause (one 60-minute session), The Path (six 50-minute sessions), and The Threshold (twelve 50-minute sessions), plus add-on sessions and partner sessions. What each Package includes, and its price, is shown on the Coaching Services page and at checkout. Coaching is not healthcare, and Everwillow does not provide pharmacy services; see our Disclaimer. We may offer sliding-scale, pro bono, referral, returning-client, or custom arrangements at our discretion.
4. Discovery calls and booking. A free 30-minute discovery call can be booked through Calendly. A discovery call is not a coaching session and creates no obligation on either side. Information you share on a call is treated as confidential as described in our Privacy Policy. A coaching relationship begins only when you sign a Coaching Services Agreement and pay or arrange payment for a Package.
5. Purchases and payment. Prices are shown in U.S. dollars. When you buy a Package, you authorize Everwillow, through its payment processor (Stripe, by Everwillow’s online checkout or an invoice), to charge your payment method for the Package and payment option you selected. You will receive a receipt for each charge. Taxes, if any, are added as required by law. We may change prices for future purchases; a price change does not affect a Package you have already purchased.
6. Payment plans. Where offered, you may pay for The Path in three monthly installments and for The Threshold in three or six monthly installments. A payment plan is a payment schedule for the same total price, with no interest or finance charge. If a payment fails, the steps in your Coaching Services Agreement apply, which may include pausing scheduling or ending the Agreement. The remaining balance stays due as the Agreement and Policy describe.
7. No automatic renewal. Packages do not renew automatically. To continue after a Package ends, you choose and buy a new Package or sign an Amendment. We do not charge your payment method for a new Package without your approval.
8. Cancellation, pausing, and refunds. Our Cancellation, Rescheduling, Pause & Refund Policy applies to every Package. In summary: sessions may be rescheduled with 24 hours’ notice; Packages of six or more sessions may be paused for up to 90 days in total; you may cancel for a refund (less sessions used, at the Single-Session Rate) within 14 days of purchase; after that, payments are non-refundable; and sessions expire 12 months after purchase (extended by any pause). The Policy controls over this summary.
9. Electronic communications and records. You agree that we may communicate with you, and deliver notices, agreements, receipts, and policies, electronically, including by email and through our booking and client platforms. You agree that electronic signatures and records are valid (federal E-SIGN Act, 15 U.S.C. § 7001 et seq.). You may ask for a paper copy of any agreement by emailing hello@everwillowcare.com.
10. Newsletter and marketing emails. If you subscribe to our newsletter or join our list, you agree to receive emails from Everwillow. Each email includes an unsubscribe link, and you may unsubscribe at any time. Our newsletter may be delivered through Substack and is subject to Substack’s terms. Subscribing is not a request for coaching and does not create a client relationship.
11. Acceptable use. When you use the Site or our services, you agree not to: (a) harass, abuse, threaten, or discriminate against anyone; (b) post or send unlawful, hateful, defamatory, or infringing content; (c) share another person’s private information; (d) impersonate anyone or give false information; (e) attempt to gain unauthorized access to the Site, our systems, or other users’ data, or interfere with their operation; (f) use bots, scrapers, or automated tools to collect content or data from the Site; (g) copy, resell, or redistribute our content beyond your personal use, or promote or sell our materials as your own; or (h) use the Site in violation of any law. We may remove content, restrict access, or end an agreement if these rules are broken.
12. Our content and intellectual property. The Site and everything we create, including text, images, graphics, logos, names (including Everwillow, The Pause, The Path, and The Threshold), worksheets, frameworks, methods, recordings, newsletters, and client materials, belongs to Everwillow or its licensors and is protected by copyright, trademark, trade secret, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site and use materials we give you for your own non-commercial benefit, as your Coaching Services Agreement describes. You may not copy, reproduce, publish, post, sell, license, adapt, or create derivative works from our content; use it to teach or create a competing program, product, or service; or use it to train or prompt any artificial intelligence or machine learning tool. All rights not expressly granted are reserved.
13. What you send us. You keep ownership of what you send us, including messages, intake information, and contact-form submissions. You give us permission to use it to respond to you, provide and support the services, and as described in our Privacy Policy. You confirm that what you send is yours to share and breaks no law or third-party right. We do not use your name, image, or story in marketing without your separate written permission.
14. Copyright complaints. If you believe content on the Site infringes your copyright, email hello@everwillowcare.com with your contact information, a description of the work and where it appears on the Site, a statement that you have a good-faith belief the use is not authorized, and a statement, made under penalty of perjury, that your information is accurate and that you are the owner or authorized to act for the owner. We will review and respond promptly.
15. Third-party services and links. The Site links to and uses services we do not control, such as Squarespace, Calendly, Zoom, Stripe, Substack, Instagram, and Linktree. We are not responsible for their content, availability, or how they handle your information. Their terms and privacy policies are their own.
16. Not healthcare. Everwillow provides coaching, not healthcare or pharmacy services. Stephanie Galt is a licensed pharmacist but does not act as your pharmacist or provider through Everwillow. Nothing on the Site is medical advice. Please read our Disclaimer, which is part of these Terms.
17. Use from outside the United States. Everwillow is based in Massachusetts and provides its services virtually from the United States. We welcome clients from other countries. You are responsible for complying with the laws that apply to you. If the laws of your location give you mandatory consumer rights that cannot be waived, those rights still apply regardless of these Terms. If you are a consumer in the European Union or the United Kingdom, you may have a statutory right to withdraw from an online purchase of services within 14 days. If you ask us to begin services during that period, you agree to pay for the services provided up to the time you withdraw, and you acknowledge that you lose the right to withdraw once the services are fully performed. Contact us at hello@everwillowcare.com to exercise any such right.
18. Disclaimer of warranties. The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in this section limits any warranty that cannot be excluded by law.
19. Limitation of liability. To the fullest extent permitted by law, Everwillow, its members, and its contractors are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, including lost profits or goodwill. For the Site, our total liability is limited to $100. For coaching services, the limitation of liability in your Coaching Services Agreement applies. These limits do not apply to gross negligence, willful misconduct, or liability that cannot be limited by law.
20. Indemnification. To the extent permitted by law, you agree to cover our reasonable losses, including reasonable attorneys’ fees, from any third-party claim arising from your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.
21. Suspension and ending. We may suspend or end your access to the Site, or end a services agreement, if you breach these Terms or your Agreement. Your rights to end a services agreement are described in your Agreement and the Policy. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) survive.
22. Changes. We may update the Site and these Terms from time to time. We will change the date at the top and, for current clients, notify you of material changes by email. Changes do not apply to a Package you have already purchased unless you agree. Continuing to use the Site after an update means you accept the update.
23. Governing law and disputes. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Before filing any claim, each of us will try in good faith to resolve the issue informally for at least thirty (30) days after written notice to the other. Any dispute that is not resolved will be brought in the state or federal courts located in Massachusetts, and each of us consents to that venue. This does not remove mandatory consumer protections that apply where you live.
24. Events beyond our control. Neither of us is responsible for delay or failure caused by events beyond reasonable control, such as illness, emergency, natural disaster, internet or platform outages, or government action. We will reschedule affected sessions as the Policy describes.
25. Accessibility. We want the Site and our services to be usable by everyone. If you have difficulty using the Site or need an accommodation for a session, email hello@everwillowcare.com and we will work with you.
26. General. These Terms and the documents referenced in Section 1 are the entire agreement between us about the Site and services. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor to our business. There are no third-party beneficiaries. Nothing in these Terms creates a partnership, agency, or employment relationship.
27. Contact. Everwillow LLC, Pittsfield, Massachusetts, USA. Email: hello@everwillowcare.com.
