  • Welcome to www.everwillowcare.com (the “Site”), operated by Everwillow LLC (“we,” “us,” “our”). By using the Site or joining as a member, you agree to these terms. If you do not agree, please do not use the Site. Questions can be directed to hello@everwillowcare.com.

  • 1) Who can use the Site

    • You must be at least 18 years old to join or use the Site. By doing so, you confirm that you are.

  • 2) Client Services/Membership

    • Everwillow offers services and community membership with access to 3-service type tiers of membership. Services are billed (How should I bill, before in full-paid per month, by invoice once service is rendered?) [monthly, quarterly, or annually] depending on the plan you choose, and will renew for the duration of the services agreement, until you agree to or cancel continued services. What is included, and the price, is shown when you join as a client member.

  • 3) Payment and auto-renewal

    • When you join,  you authorize us, through STRIPE, to charge your payment method for the services you selected, and to charge it again automatically at the start of each agreed upon service (???). You will receive a receipt for each charge. If a payment fails, we may pause or end your access to services until it is resolved.

  • 4) Cancellation

    • You may cancel your services agreement at any time by written notice to hello@everwillowcare.com. Cancellation takes effect at the end of your services rendered agreement, you will continue to have access to client material through that period. Approval to cancel is required, due to the clients understanding and agreement to the services rendered contract agreement.

  • 5) Refunds

    • Client services agreed upon are not refunded for the duration of the agreement. If the client has prepaid for services, that payment is non-refundable, however, the client can choose to resume services within 3-months of the refund or cancellation request date, at no additional charge.

  • 6) Pausing your services

    • You may pause your client service agreement for up to 90-days. Pausing suspends both your access and your billing for that time. To pause or make other changes to your plan, send written notice to hello@everwillowcare.com. The changes take effect on the date of your written notice, or as otherwise stated.

  • 7) International clients

    • Clients may enroll in services from outside the United States, and we welcome that. If you are in a location whose laws give you mandatory consumer rights that cannot be waived, those rights still apply to you regardless of anything in these terms. If you are a consumer in the European Union or United Kingdom, you may have a statutory right to withdraw from an online purchase within 14 days, except where you have agreed to begin accessing digital content immediately and waive that right. Contact us at hello@everwillowcare.com to exercise any such right.

  • 8) Client/Member conduct

    • Our community depends on trust. When taking part, you agree not to:

      • Harass, abuse, or threaten.

      • Post unlawful, hateful or infringing content.

      • Share others private information or material outside the community.

      • Promote or sell our digital products as your own.

      • Copy or redistribute content beyond your own personal use.

    • We may remove content, pause access, or end an agreement if these rules are broken.

  • 9) Our content

    • The Site and everything we create for our client members, including text, images, logos and member materials, belongs to Everwillow and is protected by copyright and trademark law. Your membership gives you personal access, not ownership. You may not copy, resell, or repost it as your own.

  • 10) Your content

    • Anything you post to the community stays yours, but you give us and other members permission to view and use it within the community as part of how it runs. You confirm what you post is yours to share and breaks no law or third-party right.

  • 11) Links to other services

    • The Site links to services we do not control. We are not responsible for their content or how they handle your information. Their terms and privacy policies are their own.

  • 12) As-is and limitation of liability

    • The Site and the community are provided “as is,” without warranties of any kind. To the fullest extent permitted by law, Everwillow LLC, is not liable for indirect, incidental or consequential damages arising from your use of the Site or membership. Where liability cannot be excluded, it is limited to the amount you paid us in the [three] months before the claim.

  • 13) Indemnification

    • You agree to cover our reasonable losses if a claim arises from your misuse of the Site, your breach of these terms, your content posted, or contract agreement.

  • 14) Ending membership

    • We may suspend or end your membership if you breach these terms. You can cancel at any time as described above.

  • 15) Changes to these terms

    • We may update these terms and conditions from time to time. When we do, we will change the date at the top. Continuing as a client member after a change means you accept the update.

  • 16) Governing law

    • These terms are governed by the laws of the Commonwealth of Massachusetts, and any dispute will be handled in the courts located in that state. This does not remove mandatory consumer protections that apply to members in other places.
